These terms govern your subscription to LicenseLapse. By subscribing you agree to them.

What the service is

LicenseLapse monitors publicly available contractor licence records and delivers a periodic report covering the county or territory you subscribe to. The report is delivered by email, normally weekly.

What we are not. We monitor public records. We are not an insurance agency, broker, producer, or adviser. We do not contact contractors, and we do not sell, solicit, negotiate, quote, bind, or place insurance coverage of any kind. Nothing in our reports is a recommendation about any person or business, and nothing we provide constitutes legal, insurance, or underwriting advice.

No warranty of accuracy

Our reports are derived from records published by government agencies. We do not verify those records, and we do not control their accuracy, completeness, timeliness, or availability.

The service is provided "as is" and "as available", without warranty of any kind. We do not warrant that reports will be accurate, complete, uninterrupted, or error-free. Before acting on any individual record, verify it against the issuing agency's own licence lookup.

Source availability

We depend on government agencies continuing to publish these records. An agency may change its publication schedule, alter its format, restrict access, or stop publishing altogether, with or without notice. If a source becomes unavailable we will tell you promptly and, if we cannot restore it, cancel your subscription and refund the unused portion.

Exclusivity

Where a subscription is sold as exclusive to a territory, we will not sell that same territory to another subscriber while your subscription is active and paid. Exclusivity applies to the territory named in your subscription and to no other.

Acceptable use

Payment and cancellation

Subscriptions are billed monthly in advance. You may cancel at any time and your subscription will run to the end of the paid period. We do not pro-rate partial months except where we discontinue a territory ourselves.

Limitation of liability

To the maximum extent permitted by law, our total liability arising out of or relating to the service is limited to the amount you paid us in the three months preceding the claim. We are not liable for indirect, incidental, consequential, special, or punitive damages, or for lost profits, lost business, or lost opportunities, even if advised such damages were possible.

Changes

We may change these terms. Material changes will be announced in the weekly report at least fourteen days before they take effect. Continuing to subscribe after that constitutes acceptance.

Governing law

These terms are governed by the laws of the State of New York, without regard to conflict-of-law principles.
